Philips CPAP And Respiratory Device Class Action

Philips CPAP And Respiratory Device Class Action

Dear Association Members,

We have been advised by the Newfoundland & Labrador Law Firm, Bob Buckingham Law that they are planning to commence a national class action on behalf of all persons in Canada who used a Philips CPAP machine, BIPAP machine or mechanical ventilator which are currently subject to a recall by the company.

Buckingham, on their website noted that “On June 14, 2021, Philips Respironics issued a recall notice in the US for approximately 35 models of its Respiratory Devices that were manufactured with a Polyester-Based Polyurethane (PE-PUR) sound abatement foam. Exposure to the PE-PUR foam can have adverse health effects including, but not limited to, increased cancer risk, respiratory damage, asthma, nausea, vomiting, and headache.

They go on to say, “It is alleged that Philips Respironics negligently designed and manufactured the Respiratory Devices and failed to warn users of the health risks associated with use of the Respiratory Devices, while assuring users of the safety of its products.

Clicking here will take you to their website which provides a list of all affected devices, the statement of claim and a class action registration form.

Buckingham are distributing this information very broadly and included the Association in their distribution.

It should also be noted that there are a number of other legal firms (Thomson Rogers, Rice Harbut Elliott LLP, and Sotos LLP engaging in similar class-action lawsuits against Philips Respironics.

Provided for the information of any members who may be affected by these lawsuits. We have no information beyond what is contained in these websites.
